License terms

Draft. These terms are a starting point for review by Sharkbyte Corp and its legal counsel, and are not in force until published without this notice.

These terms govern licenses of Sharkhex Spaces, Sharkhex Delivery and Sharkhex Classifieds, which Sharkbyte Corp ("Sharkbyte") sells through this website. By activating a license key, or by downloading the product, you accept them.

The license

A license is a perpetual, non-exclusive, non-transferable right, for the licensee named in the order. Each product has two tiers.

A Sharkhex Spaces license is the right to install and run one copy of the product on one server:

• Standard. The product serves one organisation: yours, or one client of yours. Reselling access to the install to third parties is not allowed.
• Extended. The product serves many organisations on one install, which you may offer to your own clients as a service, under your brand. The extended license does not allow you to sell or sublicense the product itself.

Each license key activates one install at a time. You may move it to another server by releasing it first.

A Sharkhex Delivery license is the right to build, publish and run the product's apps and backend:

• Standard. One delivery platform, for one business: yours, or one client of yours.
• Extended. A platform for each of your clients, each under its client's brand and on its client's accounts. The extended license does not allow you to sell or sublicense the product itself.

A Sharkhex Classifieds license is the right to build, publish and run the product's apps and backend:

• Standard. One marketplace, for one business: yours, or one client of yours.
• Extended. A marketplace for each of your clients, each under its client's brand and on its client's accounts. The extended license does not allow you to sell or sublicense the product itself.

Updates and support

Updates of the product are included for the life of the license. Email support is included and answered within one business day; it covers installing, running and upgrading the product, not custom development, which Sharkbyte offers as a service.

What you may not do

You may not remove license checks or notices, redistribute the archives, reverse engineer the product except where the law allows it, or use the product to break the law.

Termination

Sharkbyte may disable a key that was obtained by fraud or used against these terms, after notice by email. Your data stays on your server.

Warranty and liability

The product is provided as it is, with no warranty beyond what the law requires. Sharkbyte's liability is limited to the price paid for the license, except where the law does not allow such a limit.

Law

These terms are governed by the laws of Romania.
